Problem when a new user registers

Hi all!
I just installed Yabbse ... everything went fine.
But there are some more or less bad errors ...  

When a new users tries to register, he gets an error message after typing his desired username and his e-mail.
(I set up YaBB to mail a random generated PW for new users. Works quite fine. )
But all user data is written to the DB, so he can log in.

Well ... OK ... the following two problems are not really errors. Think I'm just too lame to get it myself running ...  
Where do I change the bg and font-color for the agreement shown at register screen?
Where to I include the header.inc & footer.inc of my HP?

Aeyyy ... i nearly forgot ... thats YaBBSe 1.1.0 i installed.

Hmmmm ...
I just saw that there are/were some bugs in the Subs.php so I replaced the original subs.php of YaBBSe 1.1.0 with the one you can downloads in the 1.1.0 bugs board, but everything changed is the line# were the error appeared. Now its line 985.
